Terms of Service

1. Definitions

"Kiwalk", "we", "us" or "our" refers to AxentSoftware SAS, publisher of the app and of the website kiwalk.app and its subdomains. "You" refers to any user of the app or website. "Kiwis" are the in-app reward units you earn. "Rewards" are the gift cards, vouchers and donations for which Kiwis can be redeemed.

2. Acceptance of the terms

By creating an account or using Kiwalk, you accept these terms. We may update them from time to time; the effective date at the top of this page reflects the latest version. Your continued use after a change constitutes acceptance of the updated terms. We will flag material changes in the app.

3. Eligibility (18+)

Kiwalk is reserved for individuals aged 18 or older. Because the app involves sponsored offers and reward redemption, we verify age at signup and do not allow minors to use the service.

4. Account and security

You are responsible for the activity on your account and for keeping your access credentials secure. One account per person. You agree to provide accurate information and to notify us of any unauthorised use.

5. Earning Kiwis

You can earn Kiwis by walking (steps validated by your phone’s motion sensors via Apple Health or Health Connect) and, optionally, through short videos, partner offers and missions, surveys, challenges and referrals. Every earning method shows its reward before you start. Daily earning is subject to a clear cap shown in the app, and the conversion rate is public and the same for everyone.

6. Nature of Kiwis

Kiwis are a virtual, promotional unit granted to you under a limited, personal, revocable and non-transferable licence. Kiwis have no monetary value, are not a currency, cannot be exchanged for cash, sold, or transferred, and do not reflect any stored value. They can only be redeemed for available rewards within the app, subject to these terms.

7. Anti-fraud rules and fair use

You must earn Kiwis through genuine activity. The following are prohibited and may lead to the removal of Kiwis, suspension or termination:

• faking steps by any means (shaking devices, bots, emulators, automation, manipulating health data);
• creating multiple or fake accounts, or abusing the referral system;
• attempting to bypass the daily cap, the device attestation or any security measure;
• any use that is unlawful, fraudulent, or harmful to Kiwalk, its partners or other users.

We apply automated and manual anti-cheat checks so genuine walkers are not diluted by abuse.

8. Redeeming rewards

Kiwis can be redeemed for the rewards available in the catalogue, which varies by country. Kiwi values, redemption minimums and availability are always shown before you convert anything. The rules that apply when you earn are the rules that apply when you redeem. We do not raise minimums to keep your Kiwis hostage. Once a reward is issued to you, it is subject to the terms of the reward provider, and it cannot generally be cancelled or refunded.

9. No income promise

Kiwalk rewards regular activity with vouchers and gift cards. It is not an investment, a job, or a way to get rich. Rewards are a bonus for moving more, not an income. We make no promise about how much you can earn.

10. Payments and optional purchases

Kiwalk is free to download and use. Any optional in-app purchase (for example a boost or premium feature) is processed through the Apple App Store, Google Play or Stripe, whose terms of use and payment apply in addition to these terms and take precedence in case of conflict. Prices are shown in your currency at the time of purchase, taxes included where applicable. Virtual items, once delivered, are not refundable except where required by law or the app-store rules.

11. Acceptable conduct

You agree to use Kiwalk in compliance with all applicable laws and not to upload or transmit content that is unlawful, abusive, defamatory, infringing, or that contains malware. We may remove content or restrict access that breaches these terms.

12. Intellectual property

All content in Kiwalk, including the Kiwalk brand, the Kiko mascot, interfaces, graphics and code, is the sole property of AxentSoftware SAS and is protected by law. You receive a limited, non-exclusive, non-transferable licence to use the app for its intended purpose only.

13. Third-party services

Kiwalk relies on and links to third-party services (app stores, health platforms, advertising and offer partners, reward providers). These are not under our control; we are not responsible for their content, accuracy or practices, and their own terms and privacy policies apply.

14. Disclaimer and limitation of liability

Kiwalk is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Being bound only by an obligation of means, we cannot be held responsible for any damage resulting from the unavailability of the service. We are not liable for indirect or consequential damages arising from your use of Kiwalk, and nothing in these terms limits liability that cannot be limited by law.

15. Termination

You may stop using Kiwalk and delete your account at any time. We may suspend or terminate your account, and forfeit unredeemed Kiwis, in case of fraud, abuse, or breach of these terms. On termination, the licence to use the app ends.

16. Governing law and jurisdiction

These terms are governed by French law. Any dispute relating to their interpretation or performance that cannot be resolved amicably will be submitted to the competent courts of Paris, France.
